The proprietor of Lot 19 shall be permitted to construct a new layout to Lot 19, in that the internal structure of the lot will be amended to contain 3 bedrooms and two bathrooms and WC, shall be permitted to penetrate common property floors for the purposes of installing floor wastes for new bathroom in the loft area, and to delete one existing skylight and install new skylights/skytube to the Scope of Works and plans by CRD described as Renovation to Unit 11, 75 Buckland Street Chippendale NSW 2018, plans numbered: FLO1 & FLO2 and RCPO1 Revision D dated November 2018. Upon completion of the renovation and installation of the new skylights (the"Works") the proprietor from time to time of Lot 19 shall have the right of exclusive use and enjoyment of the area occupied by the Loft and the Skylights. The following conditions apply: a. Prior to commencement of the construction of the works the proprietor shall obtain the approval of all necessary authorities whose requirements pertain to the works and in performing the works shall comply with all directions, orders and requirements of the said authorises, including fire regulations, and shall insure and be responsible for compliance with such directions, orders and requirements by their servants, agents and contractors. b. The work shall be carried oni n a proper and workmanlike manner by duly licensed tradespeople. c. The proprietor shall indemnify and keep indemnified the Owners Corporation against: i. Any sums payable by the Owners Corporation by way of increasedi nsurance premiums as a direct or indirect result of the works of the use of the relevant area of the common property permitted by this by-law. ii. All proceedings, claims, demands, costs, damages and expenses which may be incurred by or made against the owners corporation and arising directly or indirectly with the works or the altered state of the common property or Lot 19. iii. Any costs of the Owners Corporation arising out of the making of this by-law. iv. Any costs or damages incurred by the Owners Corporation for which it becomes liable as a result of the works. v. Reasonable professional fees for any experts retained by the Owners Corporation to supervise of advise upon the works. d. The proprietor shall maintain the works and keep them in a state of good and serviceable repair and perform repairs to the works when the Owners Corporation shall reasonably so require, in a manner approved or directed by the Owners Corporation, acting reasonably. e. In the event that the proprietor fails or neglects to comply with the conditions of the subclause or to discharge any duty referred to herein and fails or neglects to comply with a written notice of the Owners Corporation requiring rectification of such failure or neglect within a reasonably. period specified in such notice, the Owners Corporation by its agents, servant and contractors may at the expense of the Proprietor carry out any appropriate maintenance or repair work or close up the loft and skylights and reinstate the common property to its condition prior to the works and for such purposes may enter Lot 19or the loft any reasonable time on reasonable notice given to the proprietor and recover the cost of doing such work as a debt from the proprietor. f. The proprietor shall ensure that there are effected for the period of the works the following insurance policies in the joint names of themselves and the Owners Corporation with the company approvedi n writing by the Owners Corporation; . Contractor all risks insurance incorporation public liability cover in an amount o£f $10 million and providing coveirn the event of claims proprietors and occupants of the Strata Scheme; ii. Workers Compensation Insurance g. In the event that there are at any time more than one proprietors for the Lot 19 this by-law shall bind such proprietors jointly and severally.
